Request that the Board waive the $480 campaign finance late fee assessed against Billy Casey, a candidate for Judge, City of Shreveport, Dist.2, Div. D, in the October 22, 2011 election, whose EDE-P campaign finance disclosure report was filed 8 days late.
Facts:
A campaign finance report disclosing all the activity (contributions and expenditures) for the 10-G reporting period was filed October 31, 2011. An election day expenditure report is filed on a different form; and, it requires disclosure of certain expenditures for election day services.

In connection with his request for a waiver of the $480 late fee assessed for the late filing of the EDE-P campaign finance report, Arnold Castellano, Jr., on behalf of the candidate, states that in his communications with the Ethics IT division, it was discovered that the EDE-P report was filed on the wrong form. He maintains that the required information was submitted timely, however, it was submitted on the wrong form. Mr. Casey is a district level candidate. This is his first campaign. He was an unsuccessful candidate.



Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

Recommendations:
Decline to waive.
