RE:
Request that the Board waive the $480 campaign finance late fee assessed against Hugh Pentney, Sr., a candidate for St. Bernard Parish Council, Eastern Division, in the October 22, 2011 election, whose 10-G campaign finance disclosure report was filed 8 days late.
Facts:
In connection with his request for a waiver of the $400 and $480 late fees assessed for the late filings of the EDE-P and 10-G campaign finance reports, Hugh Pentney, Sr. states that he timely mailed both the EDE-P report and 10-G report. However, he received notice from the Campaign Finance division that he was delinquent with his 10-G report. When he contacted the Campaign Finance division to inquire about the late notice, he was told that he filed his 10-G report on the wrong form. He maintains that he did in good faith send in a report that he thought was correct which included the financial information that was due. Mr. Pentney is a district level candidate. This is his first campaign. He was an unsuccessful candidate.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

Recommendations:
Suspend all but $200 based on future compliance.
