RE:
Request that the Board waive the $480 campaign finance late fee assessed against Albert "A.B." Franklin, a candidate for State Representative, 34th District, in the October 22, 2011 election, whose 10-G campaign finance disclosure report was filed 8 days late.
Facts:
In connection with his request for a waiver of the $480 late fee assessed for the late filing of the 10-G campaign finance report, Jonald Walker, III, on behalf of the candidate states that on November 7, 2011 he called the Louisiana Board of Ethics to confirm what report the candidate needed to file. He maintains that a representative at the Ethics Board informed him that if the candidate won the election and was not in a run-off, he would not have to file a 10-G report, only an Annual report at the end of the year. He further states that after receiving a delinquency notice for the 10-G report, he contacted the IT department and spoke with Gene Dawson, who informed him that a 10-G report was required, since it's the final report of the primary election. Mr. Franklin is a district level candidate. This is his 6 th campaign. He was a successful candidate.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
