RE:
Request that the Board waive the $280 campaign finance late fee assessed against Charles Daniels, a candidate for St. Landry Parish Council, District 6, in the October 22, 2011 election, whose EDE-P campaign finance disclosure report was 7 days late.
Facts:
In connection with his request for a waiver of the $280 late fee assessed for the late filing of the EDE-P campaign finance report, Charles Daniels states that his wife's sister passed away on the date that the report was due. He maintains that being concerned with his wife's loss, family and funeral arrangements, filing of the report totally slipped his mind. It was not until he received notice from the Campaign Finance division, that he realized he had not filed the report. He filed the report immediately upon receipt of notice. Mr. Daniels is an any other level candidate. This is his first campaign. He was an unsuccessful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.



Recommendations:
Suspend all but $100 based on future compliance.
