RE:
Request that the Board waive the $320 campaign finance late fee assessed against Ellis J. "Pete" LeJeune, a candidate for Acadia Parish Police Juror, District 4, in the October 22, 2011 election, whose 10-G campaign finance disclosure report was filed 8 days late.
Facts:
In connection with his request for a waiver of the $320 late fee assessed for the late filing of the 10-G, Ellis J. "Pete" LeJeune states that he filed the 10-G campaign finance report by the due date. He can only assume that the report was not received. He maintains that it was always his intent to file all necessary reports in a timely manner, and apologizes if this goal was not attained. He is new to the election process and attempted to meet all of the requirements. Mr. LeJeune is an any other level candidate. This is his first campaign. He was an unsuccessful candidate. Campaign Finance records show that the 10-G campaign finance report was mailed and the envelope post marked November 17, 2011.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

Recommendations:
Suspend all but $100 based on future compliance.
