Request that the Board waive the $240 campaign finance late fee assessed against Ken Wheat, a candidate for Washington Parish Council, District 1 in the October 22, 2011 election, whose EDE-G campaign finance disclosure report was filed 6 days late.
Facts:
In connection with his request for a waiver of the $240 late fee assessed for the late filing of the EDE-G campaign finance report, Ken Wheat states that he contacted the Campaign Finance division within the first couple of days after the general election, to make sure he would be filing the appropriate reports. He maintains that he was told that the EDE-G report was not required and that the only report he was required to file was a 40-G report. He further states that he has been in office for 25 years, has had 7 campaigns and has never been late with any of his reports. He has always read the guidelines for campaign reports and always tried to stay up to date with the requirements by contacting the Ethics' office for clarification and reassurance. Mr. Wheat is a district level candidate. He was an unsuccessful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
