Request that the Board waive the $1,050 campaign finance late fee assessed against Albert Foulcard, a candidate for St. Mary Parish Council, District 9 in the October 22, 2011 election, whose 10-P campaign finance disclosure report was filed 28 days late. |

In connection with his request for a waiver of the $1,050 late fee assessed for the late filing of a 10-P campaign finance report, Albert Foulcard states that it was his understanding that the 10-P report was due on November 9, 2011. He further states that he was fined in the past for filing a report untimely and gladly paid because it was his fault. He further states that since then, after every election, he has contacted the Ethics Board for accuracy. He maintains that this time he called to check on his status and was told that if he did not spend over five thousand dollars, no report was needed. He was told to file other reports and he did so as soon as possible. Mr. Foulcard is a district level candidate. This is his seventh campaign. He was a successful candidate. According to the Campaign Finance filing schedule for the October 22, 2011 election, the 10-G (tenth day prior to the general election) campaign finance disclosure report was due by November 9, 2011, not the 10-P.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
