Request that the Board waive the $600 campaign finance late fee assessed against Walter Lee, a candidate for Evangeline Parish Clerk of Court in the October 22, 2011 election, whose EDE-P campaign finance disclosure report was filed 6 days late.
Facts:
In connection with his request for a waiver of the $600 late fee assessed for the late filing of the EDE-P campaign finance report, Dirk Deville, on behalf of the candidate, states that he advised the candidate that he was not required to file an EDE-P report. The candidate later received notice of the requirement to file an expenditure report, and upon receipt of notice, a report was immediately filed. Mr. Deville further states that the candidate has served Evangeline Parish as its Clerk of Court since 1956 without blemish. He maintains that the candidate at the age of 90 has suffered from strokes during the last term of his office and is now wheelchair bound. The candidate will retire at the end of his current term. Mr. Lee is a district level candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
