Advisory opinion regarding whether State Representative Bryan Adams may be employed by a fire truck sales dealer.
Facts:
Bryan Adams is the State Representative for District 85. Mr. Adams was previously employed by a fire truck sales dealer. Rep. Adams never sold fire trucks to entities which used state dollars to purchase the trucks. The fire trucks sold were to municipalities, parishes and non-profit fire companies that provided services to municipalities and parishes. Rep. Adams intends to work in the same field again.

Law:
La. R.S. 42:1113C provides no legislator, member of his immediate family, or legal entity in which he has a controlling interest shall bid on or enter into or be in any way interested in any contract, subcontract, or other transaction involving the legislator's agency.

La. R.S. 42:1113D(1)(a)(i) prohibits any member of the legislature, the spouse of such member, and any legal entity of the member from entering into any contract with state government.

La. R.S. 42:1113D(1)(a)(iii) defines a "legal entity of a person" to mean any corporation, partnership, or other legal entity in which a person identified in Item (ii) of this Subparagraph or the spouse of such person owns an interest of greater than five percent, except a publicly traded corporation or a legal entity in which the person owns a passive interest that is the result of participation in a federally approved program of employee ownership.

Recommendations:
Adopt proposed advisory opinion.
