Advisory opinion request regarding the continued employment of Sharon Dupuy as an Administrative 3 at Avoyelles office of the Department of Children and Family Services since her recent marriage to Jason Dupuy, Area Director of the Department of Children and Family Services (DCFS) at the Avoyelles Parish DCFS office.
Facts:
Jason Dupuy has been employed with the Department of Children and Family Services (DCFS) for nearly 33 years. Mr. Dupuy is Area Director of DCFS located at the Avoyelles parish DCFS office. His coverage is limited to four offices within a five parish area in the Alexandria region.

Mr. Dupuy directly supervises four employees. Mr. Dupuy supervises Maude Scott, a Family Support Parish Manager 2, for the Avoyelles DCFS office. Ms. Scott directly supervises John Nugent, a Social Services Analyst Supervisor in the Avoyelles DCFS office. Mr. Nugent directly supervises Sharon Dupuy, an Administrator Coordinator 3 at the Avoyelles DCFS office.

Ms. Dupuy has been employed with DCFS since September 24, 2007. In February 2011, Sharon Dupuy began dating Jason Dupuy. They were married on November 11, 2011.

Mr. Dupuy states that he does not now nor has he ever made any decisions regarding Ms. Dupuy's job duties, performance evaluations, leave or other matters regarding her employment with DCFS.

Law:
La. R.S. 42:1119A states that no member of the immediate family of an agency head shall be employed in his agency.
La. R.S. 42:1119C(2) provides a limited exception to the general nepotism prohibition and allows the continued employment and normal promotional advancement of a public employee when a member of the public employee's immediate family becomes the agency head of the public employee's agency, provided that such public employee has been employed in the agency for a period of at least one year prior to the member of the public employee's immediate family becoming the agency head.

La. R.S. 42:1112B(1) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.

Recommendations:
Adopt proposed advisory opinion.
