Advisory opinion request regarding Tammy Davis, a former Foster Care Supervisor, contracting with Northwestern University to provide child welfare coaching services to supervisors and employees of the Department of Children and Family Services.
Facts:
Tammy Davis is a former Foster Care Supervisor with the Department of Children and Family Services (DCFS). Ms. Davis retired on July 2, 2011.

DCFS has contracted with Northwestern University to provide Child Welfare Coaching Services to workers and supervisors of DCFS. The Child Welfare Coach will collaborate and coordinate with the child welfare supervisor to create and implement a professional development plan for the trainees in the assigned region. The Child Welfare Coach will play a key role in supporting and assisting the Child Welfare Trainee to improve their performance as they work with children, families, providers and other stakeholders involved in the child welfare system. The Coach will also provide individual and small group training. The Coach may also develop curriculum, update curriculum's, research assigned training topics and provide classroom training. The Coach will no be responsible for any case decisions.

Ms. Davis believes she will be assigned the region which encompasses the local parish office from which she retired. Ms. Davis states that there are many cases that still remain in the parish office that she personally supervised and that these as well as former cases will be the source of discussion during the training sessions. Ms. Davis states that although she will only be a consultant, she may be asked to defend previous decisions she made as a supervisor.

Law:
La. R.S. 42:1121A(1) prohibits a former agency head, for a period of two years following the termination of his public service as the head of such agency or as an elected public official serving in such agency, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving his former agency or render any service on a contractual basis to or for such agency.


La. R.S. 42:1121B prohibits a public servant, for a period of two years following the termination of his public employment, from rendering any service which such former public employee rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
La. R.S. 42:1121B prohibits a former public servant, for two years, from assisting another person, for compensation, in a transaction in which she participated during her public employment and which involves the governmental entity.

La. R.S. 42:1102(16) defines "person" to mean an individual or legal entity other than a governmental entity, or an agency thereof.

Recommendations:
Adopt proposed advisory opinion.
