Advisory opinion regarding whether a former engineer/project manager for the Department of Public Works, City of New Orleans, Bao Vu, may accept employment with an engineering firm that does business with the City of New Orleans.
Facts:
Bao Vu states that he is a former project manager/principal engineer for the Department of Public Works, City of New Orleans. He retired on February 3, 2012. As project manager, Mr. Vu was responsible for approving plans and specifications for streets reconstruction projects prepared by different engineer firms who contracted with the City. He is seeking employment with Jacob Engineering Co.

Jacobs has a current contract with the City of New Orleans through the Mayor's office to manage the street rehabilitation program funded by FEMA. As an employee of Jacobs, Mr. Vu will continue to review plans and specifications for FEMA streets rehabilitation program in New Orleans. Mr. Vu states that he has never been involved in any of the street projects with Jacobs engineering.

Law:
Section 1121A of the Code prohibits an agency head for a period of two years following the termination of his employment with his former agency, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction, with his former agency or render any service on a contractual basis to or for such agency.
Recommendations:
Adopt the advisory opinion.
