Request for an advisory opinion regarding possible conflicts of interests of members of the Foundation for Terrebonne General Medical Center. |

Terrebonne General Medical Center (TGMC) is a hospital service district facility in the State of Louisiana. Recently, steps were initiated to form a foundation to obtain funding to further the services provided by TGMC. Articles of Incorporation have been approved and recorded with the Secretary of State. Further, IRS form 1023 was submitted so that not-for-profit (501(c)(3)) status may be granted to the foundation. No Foundation board member receives any compensation for his or her services with the foundation.

R.S. 42:1111A prohibits a public servant from receiving anything of economic value for the performance of his job duties other than the compensation and benefits from the governmental entity to which he is duly entitled. R.S. 42:1115 of the Code prohibits public employees from soliciting or accepting a thing of economic value from persons that have or are seeking to have a business, financial or contractual relationship with their public agency;
