Waiver request submitted by Dan LeBlanc regarding a $1,050 late fee assessed for filing his 2011-2012 school board disclosure statement 21 days late.
Facts:
Dan LeBlanc is a member of the Iberia Parish School Board. Within 30 days of the start of the school year, each school board member is required to file a school board disclosure statement disclosing the employment of any immediate family members with the school board. The 2011-2012 school board disclosure statement was due on or before September 9, 2011. The report was not filed until September 30, 2011, 21 days late. A $1,050 late fee was assessed.

Law:
La. R.S. 42:1119B(2)(a)(iii) requires that within thirty days after the beginning of each school year, any school board member or superintendent whose immediate family member is employed by the school board shall file a disclosure statement with the Board of Ethics stating the facts of such employment. Any person who fails to timely file a disclosure statement may be assessed a late fee of fifty dollars per day, not to exceed $1,500.

Recommendations:
Waive all but $200.
