Request for an advisory opinion regarding whether Dr. Derris Ray may be appointed to the Board of Directors for Hood Memorial Hospital. |

Hood Memorial Hospital will have to fill a vacancy on its Board of Directors. The Parish Council member for the third ward in which the hospital is located has requested the vacancy be filled by a physician as there currently is no physician representation on the board.
Since March 2009, Dr. Derris Ray has served as the collaborating physician for the nurse practitioner who see patients in the hospital's rural health clinic. Dr. Ray receives $1000 per month for providing oversight to the nurse practitioner. Dr. Ray is not paid on the hospital's payroll and he does not receive a W2 from the hospital. Dr. Ray is paid on a manual vendor check and he is provided with IRS form 1099 at the end of each year.

R.S. 42:1113A(1)(a) prohibits public servants, their immediate family members, or legal entities in which they have a controlling interest, from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servants.
