Request that the Board waive the $480, campaign finance late fee assessed against Marva A. Lumar, a candidate for St. John the Baptist Clerk of Court, in the October 22, 2011 election, whose EDE-P campaign finance disclosure report was filed 8 days late.
Facts:
In connection with her request for a waiver of the $480 late fee assessed for the late filing of an EDE-P campaign finance report, Marva A. Lumar states that her report was late due to her being ill the week of the election through January 2012. She maintains that she experienced tremendous pain due to having kidney stones and was hospitalized on November 6, 2011. She ask that the Board consider her medical problem and waive the $480 late fee. Ms. Lumar is a district level candidate. This is her first campaign. She was an unsuccessful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

Recommendations:
Suspend all but $200 based on future compliance.
