Request that the Board waive the $360 and reassessed $600 campaign finance late fees assessed against Cynthia N. Robertson, a candidate for State Representative, District 5, in the October 22, 2011 election, whose EDE-P campaign finance disclosure report was filed 6 days late.
Facts:
In connection with her request for a waiver of the $360 and reassessed $600 late fees assessed for the late filing of an EDE-P campaign finance report, Cynthia N. Robertson, states that she did not receive any funds or donations and used her own funds of $390 to pay for yard signs. She further states that it was her understanding that candidates who used their own funds under the amount of $500, were not required to file a report. Ms. Robertson is a district level candidate. This is her third campaign. She was an unsuccessful candidate.

In Ethics Board Docket No. 2010-467, the Board suspended all but $200 of the $400 and $400 in late fees imposed for filing two (2) Supplemental campaign finance disclosure reports 16 days late, in connection with the September 30, 2006 and October 20, 2007 elections. The suspension of the $600 was conditioned upon future compliance with the Campaign Finance Disclosure Act, therefore, the $600 is now being reassessed as a result of this new late filing.

Two Supplemental campaign finance reports each filed 16 days late, in connection with the September 30, 2006 election and October 20, 2007 election. The late fees assessed for the late filings of the reports have been paid.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
