Request that the Board waive the $540 campaign finance late fee assessed against Tanner "T. A." Messina, Jr., a candidate for City of Alexandria Court Marshall, in the October 22, 2011 election, whose EDE-P campaign finance disclosure report was filed 9 days late.
Facts:
In connection with his request for a waiver of the $540 late fee assessed for the late filing of an EDE-P campaign finance report, Tanner "T. A." Messina, states that when he was a candidate in the October 4, 2008 election, he was not required to file an EDE-P report, if he did not have any expenditures for the date of the election. He maintains that he was following the same rules from 2008 and believed he was not required to file a report. He further states that his ignorance is no excuse for the law changing and it would not have been a problem to file the report on time if he had only read the new laws that changed from 2008. Mr. Messina is a district level candidate. This is third campaign. He was an unsuccessful candidate.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
