RE:
Request that the Board waive the $1,600 campaign finance late fee assessed against Health Agents, PAC, a political action committee, whose 10-G campaign finance disclosure report was filed 8 days late.
Facts:
In connection with his request for a waiver of the $1,600 late fee assessed for the late filing of a 10-G campaign finance report, Doug Jones, on behalf of the committee, states that the late filing of the 10-G report is a first-time occurrence for the committee. He further states that their part-time administrator sustained a personal medical issue beyond her control on the day before the report was due. He maintains that the administrator was in agonizing pain and was required to submit to a CT Scan that revealed the necessity for her to undergo surgery to remove her gall bladder. Ms. Angela Burley, the committee's administrator, has provided medical documentation to support her claim that she was medically unable to timely file the committee's 10-G campaign finance report.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.



Recommendations:
Suspend all but $500 based on future compliance.
