RE:
Request that the Board waive the $40 and $280 campaign finance late fees assessed against Jeff Allen Joiner, a candidate for Tangipahoa Parish Council, District 8 in the October 22, 2011 election, whose 10-P and 10-G campaign finance disclosure reports were filed 1 and 7 days late.
Facts:
In connection with his request for a waiver of the $40 and $280 late fees assessed for the late filings of a 10-P and 10-G campaign finance reports, Jeff Allen Joiner states that he faxed his 10-P campaign finance report on the date it was due. He further states that he has diligently searched for the confirmation page, but cannot locate it. As for the 10-G campaign finance report, he states that it is an honest mistake that the report was not timely filed. He thought that it was sent in, but he honestly just missed the date due to other matters involving work, family, and campaigning. He ask that the Board waive the late fees, or in the alternative reduce them. Mr. Joiner is an "any other" level candidate. This is his first campaign. He was an unsuccessful candidate.



Staff contacted Mr. Joiner to obtain more information regarding the fax number used to fax is 10-P report. In speaking with Mr. Joiner, he stated that on the day that the 10-P report was due, he tried faxing the report numerous times, but was unable to get the fax to go through. He decided to wait until the next day to fax his report.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
