RE:
Request that the Board waive the $600 campaign finance late fee assessed against John William "Johnny" Daves, a candidate for Sheriff of Tensas Parish in the October 22, 2011 election, whose EDE-P campaign finance disclosure report was filed 13 days late.
Facts:
In connection with his request for a waiver of the $600 late fee assessed for the late filing of an EDE-P campaign finance report, John Williams "Johnny" Daves states that he went to a public office holder for advice and help in making sure his reports would be properly filed. He further states that he was told that as long as he did not spend in excess of $5,000 and did not accept any contributions, that he could file in lieu of. He read through the filing instructions and did see the $5,000 limit and set his goal not to exceed the limit in his spending. As for his EDE-P campaign finance report, he made notation on the report that it was his final report, and believed that the report was properly filed. Later, he received notice from the Campaign Finance division that his EDE-P report had not been filed. At that time, he contacted the Ethics office and was informed that he had not filed his reports properly. He had exceeded the $250 amount that could be spent out of his personal funds, and would need to re-file all of his reports. Mr. Daves further states that paying the late fee would cause his family financial hardship. He ask that the Board waive the late fee, or in the alternative, allow him to make monthly $100 payments until paid in full. Mr. Daves is a district level candidate. This is his third campaign. He was an unsuccessful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
