In connection with his request for a reconsideration of a waiver of the $600 late fee assessed for the late filing of a Supplemental campaign finance report, Mark D. Chiasson maintains that he did not have actual knowledge of a letter from the Campaign Finance Division advising him of the requirement to file a report by February 15, 2011. He states that the letter was sent to his closed post office box. He states that he had no notice of the requirement to file until he received a letter dated August 4, 2011 (certificate of vote), was sent by regular mail sent to his physical address. It was at that time he immediately filed a Supplemental report. Mr. Chiasson maintains that had he knowingly filed the report past the due date, he would pay the late fee and accompany a letter of apology with it, however, this is not the case in this matter. Mr. Chiasson is a district level candidate. This is his first election. He was a successful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S. 42:11457 for each day until such report is filed.
