Advisory opinion regarding whether Lynne Beard may be reappointed to the Leesville Historic District Commission when her brother, C. Robert Rose, is Mayor or the City of Leesville. |

Lynne Beard is the current chairperson of the Leesville Historic District Commission. She was appointed by the former mayor, Betty Westerchil, and confirmed by City Council approval in 2008. In 2010, her brother, C. Robert Rose was elected as Mayor of the City of Leesville, and Ms. Beard continued to serve under Mayor Rose's administration. Ms. Beard's term ends in 2012.

R.S. 42:1113A(1)(a) prohibits public servants, their immediate family members, or legal entities in which they have a controlling interest, from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servants.
R.S. 42:1102 (23) of the Code defines "transaction involving the governmental entity" to mean "any proceeding, application, submission, request for a ruling or other determination, contract, claim, case, or other such particular matter which the public servant or former public servant of the governmental entity in question knows or should know: (a) Is, or will be, the subject of action by the governmental entity. (b) Is one to which the governmental entity is or will be a party. (c) Is one in which the governmental entity has a direct interest. A transaction involving the agency of a governmental entity shall have the same meaning with respect to the agency."
