RE:
Request that the Board waive the $1,600 campaign finance late fee assessed against St. Bernard Citizens for Ethical Government, a political action committee, whose 10-G campaign finance disclosure report was filed 8 days late.
Facts:
In connection with his request for a waiver of the $1,600 late fee assessed for the late filing of a 10-G campaign finance report, Donald R. Bourgeois, Jr., on behalf of the committee, states that he was unaware of the requirement to file a 10-G campaign finance report. He further states that he formed an LLC to write newspaper articles against a local political figure. He filed a report to disclose contributions he made and accepted from others. He states that he received a call from a compliance officer with the Campaign Finance division, to find out why he was filing a report. It was at that time when he was told that he needed to file a Statement of Organization, which he did file. Later, he received certified mail notifying him of the requirement to file a 10-G report, which he immediately filed upon receipt of the notice. He ask that Board consider his request for leniency.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

Recommendations:
Suspend all but $500 based on future compliance.
