RE:
Request that the Board waive the $900 and $900 campaign finance late fees assessed against Domoine D. Rutledge, a candidate for BESE, District 8 in the October 22, 2011 election, whose EDE-P and 10-G campaign finance disclosure reports were each filed 9 days late.
Facts:
In connection with his request for a waiver of the $900 and $900 late fees assessed for the late filings of an EDE-P and 10-G campaign finance reports, Domoine D. Rutledge, states that with regard to his EDE-P report, he did not file the report because he had no election-day expenditures. Upon receiving notice from the Campaign Finance, he immediately filed the report. As for his 10-G report, Mr. Rutledge states that he was under the impression that he was not required to file the report since his candidacy terminated on October 22, 2011 and he did not participate in the general election. Upon receiving notice from the Campaign Finance division, he immediately filed the report. Mr. Rutledge is a major level candidate. This is his first campaign. He was an unsuccessful candidate.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

Recommendations:
Suspend all but $300 of the fine for the EDE-P report and decline to waive the fine for the 10-G report.
