Advisory opinion regarding whether Ora Rice, an employee of the Department of Child and Family Services, may become a Child Welfare Coach through a contract with Northwestern State University.
Facts:
Ora Rice is a part-time employee of the Department of Child and Family Services (DCFS). She is employed on as an as-needed program managers and her duties include peer review of files to ensure compliance with applicable laws and procedures, as well as work on program improvement.



Ms. Rice is seeking clearance to become a Child Welfare Coach under a contract between DCFS and Northwestern State University. The Child Welfare Coach will collaborate and coordinate with the child welfare supervisor to create and implement a professional development plan for the trainees in the assigned region. The Child Welfare Coach will play a key role in supporting and assisting the Child Welfare Trainee to improve their performance as they work with children, families, providers and other stakeholders involved in the child welfare system. The Coach will also provide individual and small group training. The Coach may also develop curriculum, update curricula, research assigned training topics and provide classroom training. This contract is under the Training Unit, a unit that is separate from the one in which Ms. Rice is presently employed.

Law:
R.S. 42:1113A prohibits public servants, their immediate family members, or legal entities in which they have a controlling interest, from entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

Recommendations:
Adopt proposed advisory opinion.
