Waiver request of Arthur Alexander regarding a $1,050 late fee assessed for filing his 2011-2012 school board disclosure statement late.
Facts:
Arthur Alexander is a member of the Iberia Parish School Board. He is required to file annual school board disclosure statements within 30 days of the first day of the school year. His 2011-2012 report was due by September 9, 2011. It was not filed until September 30, 2011, 21 days late. He was assessed an automatic late fee of $1,050. Mr. Alexander states he signed the disclosure report on August 9, 2011 and it was given to the school board secretary for mailing. He states it was the school board responsibility to file the report.

Law:
La. R.S. 42:1119B(2)(a)(iii) requires that within thirty days after the beginning of each school year, any school board member or superintendent whose immediate family member is employed by the school board shall file a disclosure statement with the Board of Ethics stating the facts of such employment. Any person who fails to timely file a disclosure statement may be assessed a late fee of fifty dollars per day, not to exceed $1,500.

Recommendations:
Waive all but $200.
