RE:
Advisory opinion regarding whether the former Director of the Cameron Parish Office of Planning and Development, Ernie Broussard, and other current employees of the Planning and Development office may accept employment with the West Cameron Port Commission.
Facts:
Cecil Sanner, District Attorney for Cameron Parish, states that Mr. Broussard retired as Director for the Cameron Parish Planning and Development office on January 18, 2012. In December 2011 (prior to Mr. Broussard's resignation) the Cameron Parish Police Jury and the West Cameron Port Commission entered into a Cooperative Endeavor Agreement . The Port Commission is a governmental entity of Cameron Parish and its members are appointed by the Cameron Parish Police Jury.

The agreement provides that the staff for the Cameron Parish Port shall provide technical support to the Cameron Parish Police Jury with issues that involve duties that were formerly performed by Mr. Broussard in his capacity as the Director of Planning and Development.

Staff employees of the Police Jury who work in the Planning and Development office will perform work for the Port but will continue to be employees of the Office of Planning and Development for payroll, retirement, and personal matters. However, these employees will be under the supervision and direction of the West Cameron Port Commission.

Law:
Section 1111A of the Code prohibits a public servant from accepting anything of economic value, other than the benefits and compensation that they are duly entitled to, for the performance of their duties and responsibilities as a public servant.

Section 1121A(1) of the Code prohibits a former agency head, for a period of two years following the termination of his public service, from assisting another person for compensation in a transaction, or in an appearance in connection with a transaction, involving his former agency or render any service on a contractual basis to or for such agency.

Section 1121B of the Code prohibits a former public servant, for two years, from assisting another person, for compensation, in a transaction in which she participated during her public employment and which involves the governmental entity.

Section 1121B of the Code also prohibits a public servant, for a period of two years following the termination of his public employment, from rendering any service which such former public employee rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.

Recommendations:
Adopt the advisory opinion.
