RE:
Request that the Board waive the $1,400 campaign finance late fee assessed against LA School Boards Association, a political action committee, whose 10-G campaign finance disclosure report was filed 7 days late.
Facts:
In connection with his request for a waiver of the $1,400 late fee assessed for the late filing of a 10-G campaign finance report, John L. Smith, on behalf of the committee states that normally their reports are filed by either their Executive Director or Assistant Executive Director. He further states that their organization was in a state of turmoil during the time that the report was due. He maintains that an employee of the organization had been involved in misappropriation of funds from their account. It was also discovered that their Executive Director, Nolton Senegal, had been aware of the theft for several years but had never reported it. As a result, Mr. Senegal was terminated. The committee named Lloyd Dressel, Assisant Executive Director, to the position of Interim Executive Director. While attempting to fulfill the duties of both the position of Executive Director and the position of Assistant Executive Director, Mr. Dressel suffered a stroke and was required to take sick leave from his position. Mr. Smith maintains that in the absence of administrative leadership, the termination of Mr. Senegal, and the health issues of Mr. Dressel, the 10-G report was filed untimely.
