Advisory opinion regarding the application of the Supreme Court case, Citizens United v. Federal Election Commission to the Campaign Finance Disclosure Act.
Facts:
J. Keith Gates, representing the Freedom Through Justice Foundation has requested an advisory opinion regarding the application of the Citizens United v. Federal Election Commission to the Campaign Finance Disclosure Act. He specifically asks questions regarding the definition of political committee, whether organizations that make independent expenditures are required to register, and whether the aggregate contribution limit provided in La. R.S. 18:1505.2K(1) applies to organizations that make contributions to other organizations and individuals who make contributions to organizations that make independent expenditures.
Law:
Rule 601A provides for affected persons to make advisory opinion request to the Board of Ethics. The party making the request must disclose their interest in the question presented. The Board may decline to render an opinion where the information is not provided.
Recommendations:
Decline to render an advisory opinion due to lack of standing.
