Request that the Board waive the $760 campaign finance late fee assessed against Patrick Bell, Sr., a candidate for Ascension Parish Council, in the October 22, 2011 election, whose 40-G campaign finance disclosure report was filed 19 days late.
Facts:
In connection with her request for a waiver of the $760 late fee assessed for the late filing of a 40-G campaign finance report, Cheryl M. Lefort, on behalf of Patrick Bell, Sr., states she was under the impression that she faxed his report on December 28, 2011. She states that on January 17, 2012, she was informed by the Campaign Finance division that Mr. Bell's 40-G report had not been filed. She explains that she inadvertently choose the wrong report to fax and was not aware of it until January 17, 2012. She maintains that a compliance officer with the Campaign finance division informed her that a report had been received, but it was a duplicate of a prior report. She was asked if Mr. Bell received notice that his 40-G report had not been filed. She maintains that Mr. Bell didn't receive notice. The notice was sent to his correct address, however, it was returned undeliverable by the post office. She maintains that if Mr. Bell had received the notice, the 40-G report would have been filed sooner. She ask that the late fee be waived or reduced. Mr. Bell is an any other level candidate. This is his third campaign. He was an unsuccessful candidate.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
