Advisory opinion regarding the applicability of the Code of Governmental Ethics to the employment of Ms. Angie Curry to by the Winnfield Police Department while her husband, Charles Curry, serves as Lieutenant with Winnfield Police Department.
Facts:
Ms. Angie Curry is employed by the Winnfield Police Department. Her husband, Charles Curry, serves as Lientenant for the Winnfield Police Department.

Law:
Section 1102(3) defines an "agency head" as the chief executive or administrative officer of an agency.


Section 1102(2)(a) defines "agency" as the department, office, division, agency, commission, board or committee, or other organizational unit of a governmental entity.

Section 1119A of the Code prohibits an immediate family member of an agency head from being employed in his agency.

Section 1112B(1) of the Code states that no public servant, except as provide in R.S. 42:1120., shall participate in a transaction involving the governmental entity in which any member of his immediate family has a substantial economic interest.

Section 1102(15) of the Code defines "participate" to mean to take part in or to have or share responsibility for the action of a governmental entity or a proceeding, personally, as a public servant of the governmental entity, through approval, disapproval, decision, recommendation, the rendering of advice, investigation or the failure to act or perform a duty.

Recommendations:
Adopt proposed advisory opinion.
