Advisory opinion regarding whether the Vermilion Tourist Commission may appoint a parish accommodations owner as a member of the Tourist Commission Board.
Facts:
Alison Miller is the Executive Director of Vermilion Parish Tourist Commission. She states that the Tourist Commission receives all of its funding from a 3% occupancy tax levied upon accommodations within the jurisdiction of the parish. The Tourist Commission makes decisions on marketing and promotions to attract tourist to the area. This results in tourist staying in accommodations in the area.
Law:
Section 1113 prohibits a member of a board or commission from entering into or being in any way interested in a transaction that is under the supervision or jurisdiction of the public servant's agency.

Section 1112 prohibits a public servant from participating in a transaction in which he or a legal entity in which he has a controlling interest have a substantial economic interest.


Section 1102(21) of the Code defines "substantial economic interest" as an economic interest which is of greater benefit to the public servant or other person than to a general class or group of persons.

Recommendations:
Adopt the advisory opinion.
