Advisory opinion regarding whether St. Helena Parish Police Jury may enter into an agreement with ConneXions of Louisiana, LLC where an employee of the Police Jury, Virginia Bell, is a member of ConneXions.
Facts:
Virginia Bell is the Grant Administrator for St. Helena Parish. She is also a board member and 25% owner of ConneXions of Louisiana, LLC. As Grant Administrator for St. Helena Parish, Ms. Bell supervises no one. The St. Helena Parish Police Jury would like to enter into a cooperative endeavor agreement with ConneXions of Louisiana, LLC to manage promote and operate the Industrial District's Park facility for St. Helena Parish.
Law:
Section 1113 of the Code prohibits a public servant or member of his immediate family from bidding on or entering into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the agency of the public servant. Section 1102 of the Code defines a person as an individual or legal entity other than a governmental entity or an agency thereof. Controlling interest is defined as an interest that exceeds twenty-five percent.

Section 1114 of the Code requires a public servant or a member of his immediate family, who derives a thing of economic value, of which, the immediate family member may be reasonably expected to know has bid on or entered into or is in anyway financially interested in any contract or any other transaction under the supervision of the public servant's agency to file a disclosure statement with the Board of Ethics stating the: 1) amount of income, 2) nature of the business, 3) name and address and relationship to the public servant, and 3) the name of the legal entity to which he is employed.



Recommendations:
Adopt the advisory opinion.
