Advisory opinion regarding whether Thomas Clark may submit a bid to become a drayman for Bossier Parish while his mother, Jeanene Clark, is employed with the Bossier Parish Registrar of Voters.
Facts:
Jeanene Clark is an employee of the Bossier Parish Registrar of Voters. Thomas Clark is the son of Ms. Clark. Mr. Clark seeks to submit a bid to the Louisiana Secretary of State to become the drayman for Bossier Parish. As the drayman, Mr. Clark would be responsible for transporting books and machines to the polling places for elections. The Secretary of State's office would have oversight of the contract between Mr. Clark and the Secretary of State.

Law:
La. R.S. 42:1113A states no public servant, or a member of such a public servant's immediate family, or a legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

La. R.S. 42:1112B(1) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.

Recommendations:
Adopt proposed advisory opinion.
