Advisory opinion regarding whether members of the Louisiana Seafood Promotion and Marketing Board (LSPMB) may participate in the LSPMB trade show booth.
Facts:
The Louisiana Seafood Promotion and Marketing Board (LSPMB) is an agency located within the Office of Fisheries, Louisiana Department of Wildlife and Fisheries. The LSPMB is composed of individuals who are engaged in the Louisiana seafood industry.

The LSPMB participates in several restaurant and seafood trade show events each year. The LSPMB has begun offering sections of its booth to Louisiana seafood businesses so they can promote their company's products and represent the Louisiana seafood industry to potential buyers.

The Food Group, one the LSPMB advertising agencies, sent a mailing to all Wholesale Retail Dealer license holders in Louisiana soliciting eight seafood businesses to participate in the NRA show for $2,500. Of the four industry members who replied to the mailing, three were LSPMB board members. The booth participants would not pay LSPMB directly, instead they would pay the trade show directly to offset the booth space costs.

Law:
R.S. 42:1113B states that no appointed member of any board or commission, member of his immediate family, or legal entity in which he has a substantial economic interest shall bid on or enter into or be in any way interested in any contract, subcontract, or other transaction which is under the supervision or jurisdiction of the agency of such appointed member.
Recommendations:
Decline to render opinion. Advise LSMBP to request another opinion in the future should it seek participation in other trade shows.
