RE:
Request that the Board waive the $280 campaign finance late fees assessed against Melinda H. Bernard, a candidate for St. Charles Parish School Board, in the October 2, 2010 election, whose Supplemental campaign finance disclosure report was filed 7 days late.
Facts:
In connection with her request for a waiver of the $280 late fee assessed for the late filing of a Supplemental campaign finance reports, Melinda H. Bernard states that when she received notice that her Supplemental report had not been filed, she thought that the notice was regarding her personal financial disclosure report. She states that her husband prepares their personal financial disclosure reports. She spoke with the School Board Secretary and realized that her campaign finance reports were due. She had her daughter file her report as soon as she realized her mistake. Ms. Bernard states that this is her first elected office and she was prompted last year when she first joined the Board as to when reports were due. She maintains that she did not receive a prompt this year. Ms. Bernard is an any other level candidate. She was a successful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

Suspend all but $100 based on future compliance.
