In connection with his request for a waiver of the $900 and $1,260 late fees assessed for the late filings of a 10-P and 10-G campaign finance reports, Curtis "Curt" Hodge states that there were unforeseen problems during his campaign. His first treasurer failed to keep proper records, and was replaced by his daughter. He further states that during the first filing period, his wife, daughter, and his aunt were hospitalized at the same time. Mr. Hodge maintains that during the last part of the election, he took care of his aunt until her passing, which took place a couple of weeks before the election. Mr. Hodge previously provided signatures of physicians as medical documentation verifying his claims that his family members were ill during the time that his reports 30-P report was due.
Mr. Hodge is a district level candidate. He was an unsuccessful candidate.

Mr. Hodge previously requested a waiver of a $1,140 late fee assessed for the late filing of his 30-P campaign finance report, in connection with the October 22, 2011 election. In BD matter No. 2011-1578, the Board at its November 18, 2011 meeting, declined to waive the $1,140 late fee, and correspondence dated November 29, 2011 was sent to Mr. Hodge informing him of same. He was also informed that he will need to pay or appeal the $1,140 late fee by December 29, 2011. Since Mr. Hodge did not appeal or pay his $1,140 late fee by December 29, 2011, a letter dated February 20, 2012 was sent to Mr. Hodge informing him that the Board will file suit if payment of his $1,140 late fee was not received by March 20, 2012.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
LAC 52:1205 provides that where an immediate family member of the person responsible for filing the candidate's reports or the report preparer dies or where the person responsible for the filing or the person who regularly responsible for filing the reports fails to file the reports on the due date because of a serious medical condition that occurred on the due date or seven days prior to the due date the Board shall rescind the late fee assessed.
