Request that the Board waive the $320 and $40 campaign finance late fees assessed against Ray Lauga, Jr., a candidate for St. Bernard Parish Council, District A, in the October 22, 2011 election, whose EDE-P and EDE-G campaign finance disclosure reports were filed 8 and 1 day(s) late.
Facts:
In connection with his request for a waiver of the $320 and $40 late fees assessed for the late filings of an EDE-P and EDE-G campaign finance reports, Ray Lauga, Jr. states that all of his other reports were mailed timely. He further states that he checked the Board of Ethics' website and saw that his reports were scanned and posted on the site on the day he received a late fee assessment. Mr. Lauga is an any other level candidate. This is his second election. He was a successful candidate.


In addition, correspondence was sent to Mr. Lauga addressing statements made in his letter of April 3, 2012. A copy of the letter is attached for reference. Also attached, is the envelope in which the EDE-P campaign finance report was mailed, which does not show a legible post mark date. Mr. Lauga was given credit for the date the report was received by the Campaign Finance division. The envelope in which the EDE-G campaign finance report was mailed, shows a post marked date of November 30, 2011. When reports are filed via U.S. mail, candidates are given credit for the date of which the envelope was post marked or the date that the report was received, if there isn't a legible post mark date.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
