In connection with his request for a waiver of the $280 late fee assessed for the late filing of a Supplemental campaign finance report, Paul A. Tabary, III, on behalf of the candidate, states that a Supplemental report filed by the candidate on February 14, 2011, reported a balance of zero, and a personal loan in the amount of $1,716.94 made by the candidate. Mr. Tabary further states that the candidate forgave the loan after the election, however, the candidate believed there were no further reporting requirements because of her account's zero balance and personal loan forgiveness. Mr. Tabary maintains that notice from the Campaign Finance division was received, and upon receipt of notice, he contacted the Campaign Finance division to inquire about the notice. At that time, he was told that because the candidate had an outstanding loan amount, she was still required to file a report. A Supplemental report for 2011 was filed reporting forgiveness of the personal loan amount. Ms. Dysart is an any level candidate. This is her seventh campaign. She was a successful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
