RE:
Request that the Board waive the $1,980 campaign finance late fee assessed against J. Chandler Loupe, a candidate for East Baton Rouge Parish Metro District Council, District 3 in the October 4, 2008 election, whose Annual campaign finance disclosure report was filed 33 days late.
Facts:
In connection with his request for a waiver of the $1,980 late fee assessed for the late filing of an Annual campaign finance report, J. Chandler Loupe, states that on February 3rd , his son was shot in the chest and suffered a spinal cord injury. He and his wife were then transferred with his son to the Spinal Center in Atlanta, GA, and his son was discharged on Good Friday. Mr. Loupe maintains that he tried to file his report from a medical facility in Atlanta via fax, but was reminded that he had to file his report electronically. The only computer set up to file his report online was at his law office, to which he did not have access to in a timely fashion. Mr. Loupe asks that the Board considers the medical emergency his family faced and waive the late fee. Mr. Loupe is a district level candidate. This is his first campaign.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1485C. Each candidate for a major or district office and each principal campaign committee of a candidate for a major or district office shall electronically file reports of contributions and expenditures with the supervisory committee. Effective January 1, 2012, Act 25 of the 2008 2nd Extraordinary Session requires Major and District office level candidates to electronically file campaign finance disclosure reports. A report is considered not filed until it is filed electronically.



52:1205B(1) provides that the staff of the Board shall rescind an assessed late fee of the candidate where an immediate family member of the person responsible for filing of the reports has died on the date the report was due or seven days prior to the due date of the report (2)or a serious medical condition prevented the responsible report preparer from preparing the reports.

Recommendations:
Rescind the $1980 late fee.
