Appearance in connection with a request that the Board waive the $900 campaign finance late fee assessed against Dale Bayard, a candidate for BESE, District 7 in the October 22, 2011 election, whose EDE-P campaign finance disclosure report was filed 9 days late.
Facts:
In connection with his request for a waiver of the $900 late fee assessed for the late filing of an EDE-P campaign finance report, Dale Bayard, states that he has served on BESE for twelve years, and cannot say that it hasn't taken a toll on him, his family and business. He further states that the demands of the position were as much or more than a legislator, since he represented 632,000 people from 9 parishes. He further states that he did not receive a salary, office allowance or money for an assistant. Mr. Bayard states his election would not have been as demanding, if this was not the case, and that he hardly used any technology money, because of the fear of noncompliance. Mr. Bayard asks that the Board reconsider the late fee assessment and waive his late fee. Mr. Bayard is a major level candidate. This is his seventh campaign. He was an unsuccessful candidate.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
