Appearance in connection with a request that the Board waive the $600 and $600 campaign finance late fees assessed against Hillery G. Johnson, a candidate for State Representative, 63rd District in the October 22, 2011 election, whose EDE-P and 10-G campaign finance disclosure reports were filed 31 and 23 days late.
Facts:
In connection with his request for a waiver of the $600 and $600 late fees assessed for the late filings of an EDE-P and 10-G campaign finance reports, Hillery G. Johnson, states that he is a first time candidate who made mistakes on his reports, which is why the reports were untimely filed. He further states that whenever he called to follow up after filing the reports, he was told to resubmit them, and he did. He then received a call asking that he resubmit one of his reports because he did not use the correct closing balance, and when he went online to pull up his report, it wasn't available at the time. Mr. Johnson maintains that it was not until a couple of days later that he was able to pull up his report and review the information so that he could resubmit his paperwork. Mr. Johnson is a district level candidate. He was an unsuccessful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
