Appearance in connection with a consideration of a Board Order ordering the payment of a late fee totaling $600 assessed against LaToya Cantrell, a candidate for Orleans Parish School Board, in the September 18, 2004 election who failed to timely file a Supplemental campaign finance disclosure report due February 15, 2005.
Facts:
LaToya Cantrell was a district level, unsuccessful candidate for Orleans Parish School Board in the September 18, 2004 election.
2006-069

Ms. Cantrell was required to file a 2004 Supplemental report which was due by February 15, 2005. The report was not filed until May 5, 2005. On May 10, 2005, Ms. Cantrell was assessed a reduced late fee of $600 for the late filing of her Supplemental report. The Board on September 21, 2006 sent a Notice of Hearing to Ms. Cantrell for the January 11, 2007 hearing in order to conduct a due process public hearing at which the Board would make the assessment of the $600 late fee final and absolute and issue an Order ordering that the late fee be paid. The Notice of Hearing which was sent via certified mail was returned unclaimed. The Board then sent notice via subpoena for the February 8, 2007 hearing which notice was received by Jason Cantrell on December 12, 2006. At the public hearing, Ms. Cantrell did not attend and the Board issued an Order making the $600 late fee final and absolute. The Board on May 3, 2007 filed suit to convert the Board order into a judgment of the 19th Judicial District Court pursuant to La. R.S. 42:1135. A judgment was rendered in the 19th Judicial District Court on October 15, 2007 ordering Ms. Cantrell to pay the $600 late fee. The $600 late fee remains outstanding.

Ms. Cantrell was required to file a 2005 Supplemental report which was due by February 15, 2006. An order was issued assessing a $4,000 late fee. However, that late fee was rescinded after the order, because the report was filed prior to the hearing. A late was assessed for the late filing that is the subject of the order in 2006-968.

Ms. Cantrell was required to file a 2005 Supplemental campaign finance disclosure report on or before February 15, 2006. Ms. Cantrell filed the Supplemental report on September 13, 2006 and was 210 days late. On September 20, 2006, Ms. Cantrell was assessed a reduced late fee of $600 for the late filing of her 2005 Supplemental report. In Ethics Board Docket No. 2006-968, the Board on September 13, 2007 issued an Order making the $600 late fee final and absolute. The $600 late fee remains outstanding.

Ms. Cantrell was required to file a 2006 Supplemental campaign finance disclosure report on or before February 15, 2007. Ms. Cantrell was sent a reminder notice on January 12, 2007 informing her of the requirement to file a Supplemental report. Ms. Cantrell was then sent a Notice of Delinquency on February 22, 2007 informing her that the report had not been filed. The Notice of Delinquency was sent via certified mail to 3623 Louisiana Ave. Pkwy, New Orleans, LA 70125. On April 12, 2007 the Board filed a charge against Ms. Cantrell for her failure to file the 2006 Supplemental report. The charge was sent via certified mail to Ms. Cantrell at the 3623 Louisiana Ave. Pkwy, New Orleans, LA 70125 address, and it appears that Mr. Cantrell signed for the charge. The Board held a public hearing in connection with Ms. Cantrell's failure to file the 2006 Supplemental report by February 15, 2007. At the public hearing the Board issued an Order requiring Ms. Cantrell to file the required report, assessing a $2,000 late fee for the late filing. The Board further ordered that an additional civil penalty of $2,000 would be assessed if the required report was not filed by August 13, 2007. A copy of the Order was sent to Ms. Cantrell at 3623 Louisiana Ave. Pkwy, New Orleans, LA via certified mail on July 17, 2007. The Board on January 15, 2008 filed suit to convert the Board order into a judgment of the 19th Judicial District Court pursuant to La. R.S. 42:1135. A judgment was rendered in the 19th Judicial District Court on March 10, 2008 ordering Ms. Cantrell to pay the $4,000 late fee and fine. The $4,000 late fee remains outstanding.

Ms. Cantrell was required to file a 2007 Supplemental campaign finance disclosure report on or before February 15, 2008. Ms. Cantrell was sent a reminder notice on January 15, 2008 informing her of the requirement to file a Supplemental report. Ms. Cantrell was then sent a Notice of Delinquency on February 22, 2008 informing her that the report had not been filed. The Notice of Delinquency was sent via certified mail to 3623 Louisiana Ave. Pkwy, New Orleans, LA 70125 and signed for by Jason Cantrell. On April 10, 2008 the Board filed a charge against Ms. Cantrell for her failure to file the 2007 Supplemental report. The charge was sent via certified mail to Ms. Cantrell at the 3623 Louisiana Ave. Pkwy, New Orleans, LA 70125 address, and was returned "unclaimed" by the USPS. The charges were re-submitted via Louisiana State Police and it appears that Mr. Cantrell signed for the charge. The Board held a public hearing in connection with Ms. Cantrell's failure to file the 2007 Supplemental report by February 15, 2008. At the public hearing held on April 29, 2009, the Board issued an Order requiring Ms. Cantrell to file the required report, assessing a $2,000 late fee for the late filing. The Board further ordered that an additional civil penalty of $2,000 would be assessed if the required report was not filed by May 29, 2009. A copy of the Order was sent to Ms. Cantrell at 3623 Louisiana Ave. Pkwy, New Orleans, LA via certified mail on May 8, 2009. Ms. Cantrell is asking that the Board reconsider the Order issued against her in Board Docket No. 2008-301 ordering her to pay $4,000.

Ms. Cantrell was sent a reminder notice on January 15, 2008 informing her of the requirement to file a Supplemental report. Ms. Cantrell was then sent a Notice of Delinquency on February 22, 2008 informing her that the report had not been filed. The Notice of Delinquency was sent via certified mail to 3623 Louisiana Ave. Pkwy, New Orleans, LA 70125 and signed for by Jason Cantrell. On April 28, 2009 the Board filed a charge against Ms. Cantrell for her failure to file the 2008 Supplemental report. The charge was sent via certified mail to Ms. Cantrell at the 3623 Louisiana Ave. Pkwy, New Orleans, LA 70125 address, and was returned "unclaimed" by the USPS. The charges were re-submitted via Louisiana State Police and it appears that Ms. Cantrell signed for the charge. The Board held a public hearing in connection with Ms. Cantrell's failure to file the 2008 Supplemental report by February 17, 2008. At the public hearing held on April 16, 2010, the Board issued an Order requiring Ms. Cantrell to file the required report, assessing a $2,000 late fee for the late filing. The Board further ordered that an additional civil penalty of $2,000 would be assessed if the required report was not filed by May 21, 2010. A copy of the Order was sent to Ms. Cantrell at 3623 Louisiana Ave. Pkwy, New Orleans, LA via certified mail on May 5, 2010. Ms. Cantrell is asking that the Board reconsider the Order issued against her in Board Docket No. 2009-216 ordering her to pay $4,000.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

Recommendations:
Decline to reduce.
