Advisory opinion regarding whether the brother of a former member of the St Mary Parish Council may provide services for the St. Mary Parish Council.
Facts:
Mark Duhon states that his brother Gary Duhon served as a member of the St. Mary Parish Council until January 2012. Mark Duhon Enterprises would like to provide services for St. Mary Parish. Mark Duhon states that he owns Mark Duhon Enterprises 100% and his brother, Gary Duhon, is not affiliated with Mark Duhon Enterprises in any kind of way.
Law:
Section 1113 of the Code prohibits immediate family of a public servant from entering into transactions that are under the supervision of the agency of the public servant.
Recommendations:
Adopt the advisory opinion.
