Advisory opinion regarding whether the Village Council of Turkey Creek can amend its Occupational License Tax. |

The Mayor of Turkey Creek, Heather Cloud, has requested that the Occupational License Tax be amended so that the tax is collected on net revenue instead of gross revenue. Currently, the Village uses the State Occupational Tax formula which is based on gross revenue. Council members are now inquiring as to whether they may take such a vote in light of the fact that Mayor Cloud owns Miss Sue's Cafe' and will benefit from such an amendment.

R.S. 42:1112 prohibits a public from participating in a transaction involving the governmental entity in which, he or any person of which he is an officer, director, trustee, partner, or employee, has a substantial economic interest.
