Advisory opinion regarding whether the Bossier Parish Library Board may use a building that is owned by the mother of a member of the Bossier Parish Police Jury.
Facts:
Patrick Jackson is the Bossier Parish attorney. He states that the Bossier Parish Library Board of Control has been looking for property to build a new library facility in south Bossier Parish. A recently elected police jury member's mother has a 1/2 interest in property located in south Bossier Parish. She would like to lease the property, for 99 years at no cost, to the Library Board to build the library. The Library Board is a separate board with statutory responsibilities and control over library matters in Bossier Parish. The Bossier Parish Police Jury appoints all members of the Bossier Parish Library Board. The lease agreement will be handled with the Library Board and the police jury member's mother.



Law:
Section 1113 of the Code prohibits a public servant or his immediate family from entering into transactions that are under the supervision of the agency of the public servant.

Section 1123 (30) of the Code allows an immediate family member of a public servant to donate services to the public servants agency. Services is defined by the Code as the use, lease, rental of movable or immovable property.



Recommendations:
Adopt the advisory opinion.
