Advisory opinion regarding whether a member of the Acadia Police Jury may provide contractual services for the 6th Ward Crowley-Gravity Drainage District.
Facts:
The 6th Ward Crowley Gravity Drainage District is a political subdivision of the state with members appointed by the Acadia Parish Police Jury. Mr. Dale Trahan was elected to the Acadia Parish Police Jury for District 4 in 2011. Mr. Trahan is also a contractor who specializes in excavation and drainage projects. The 6th Ward maintains a certified drainage canal known as Bayou Blanc. The 6th Ward was engaged in litigation with a landowner concerning the placement of debris along the drainage channel. A consent judgment was rendered where it was agreed that the landowner would remove part of the debris and the 6th Ward was responsible for removal of the remaining debris. The landowner hired Mr Trahan to remove the debris. The 6th Ward would like to hire Mr. Trahan to remove the remainder of the debris.
Law:
Section 1113 of the Code prohibits a public servant from entering into contracts, subcontracts, or other transactions that are under the supervision of the agency of the public servant.


Agency for members of a governing authority is defined by the Code as the governmental entity. Governmental entity means the state or political subdivision to which the elected official was elected.

Recommendations:
Adopt the advisory opinion.
