RE:
Reconsideration of a request that the Board waive the $420, $480, and $1,680 campaign finance late fees assessed against Otis Chisley, a candidate for State Representative, District 17, in the October 22, 2011 election, whose Special, EDE-P, and 10-G campaign finance disclosure reports were filed 7, 8, and 28 days late.
Facts:
In connection with his request for a reconsideration of a waiver of the $420, $480, and $1,680 late fees assessed for the late filings of a Special, EDE-P, and 10-G campaign finance reports, Otis Chisley, Jr. maintains that he became ill during the campaign and was not able to finish campaigning. He maintains that he had surgery, was on medication, and was in severe pain. Mr. Chisley states that he previously forwarded copies of the hospital bills and was still denied a waiver or at least a reduction of his late fees.

In addition, the Board at its April 20, 2012 meeting, considered Mr. Chisley's request for a waiver of the late fees, and declined to waive the late fees. Mr. Chisley is a district level candidate. This is his third campaign. He was an unsuccessful candidate.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
52:1205 provides that the staff for the Board shall rescind assessed late fees where the person who regularly prepares the reports had a serious medical condition that prevented the person from timely filing the required reports.

Recommendations:
In accordance with LAC 52:1205, rescind the late fees.
