In connection with his request for a reconsideration of a waiver of the $760 late fee assessed for the late filing of a 40-G campaign finance report, Patrick Bell, Sr., states that his report preparer, Chery LeFort, was under the impression that she faxed his report on December 28, 2011. However, she inadvertently faxed the wrong report and was not aware of it until January 17, 2012. He states that a compliance officer with the Campaign finance division informed the report preparer that she sent in the wrong report, a duplicate of a prior report. She was asked if he received notice that his 40-G report had not been filed, and she informed that he did not receive notice. The notice was sent to his correct address, however, it was returned undeliverable by the post office. He maintains that had he received the notice, the 40-G report would have been filed sooner. This is his third campaign. He was an unsuccessful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
